These Terms of Use govern how you use the Toerdle app and your Toerdle account. How we process your data is described in the Privacy Policy.
The essentials
- You need an Apple or Google account for Toerdle and must be at least 16 years old.
- You can use the diary, calorie plan and workouts without Pro. You can use friends, challenges and leaderboards only if you agree to share your health and fitness values.
- If you agree to share, every signed-in Toerdle user sees your display name and your profile photo.
- Be fair: no offensive, unlawful or other people's content, no manipulating leaderboards.
- You report content and people in the app or by email to support@toerdle.app.
- You buy Toerdle Pro through the App Store and cancel it in your Apple Account.
- Toerdle is not a medical device and does not replace medical advice.
The following sections are binding.
1. Provider and scope
Toerdle is provided by Nils Vogel, Posenerstraße 3, 35510 Butzbach, Germany (see Imprint). These terms apply between you and the provider for the Toerdle app with the Apple Watch app, widgets and shortcuts, and for your Toerdle account.
2. Apple's license terms and these terms
You download Toerdle from the App Store. The license to the app is governed by Apple's Licensed Application End User License Agreement (Standard EULA): apple.com/legal/internet-services/itunes/dev/stdeula.
These Terms of Use supplement the Standard EULA. They cover what the Standard EULA does not: your account, sharing health data, the social features, your content, reporting and blocking, and Toerdle Pro. If the two conflict, the Standard EULA governs the license to the app and these terms govern everything else. Mandatory rights you have as a consumer always remain unaffected.
3. What Toerdle is and what it isn't
Toerdle is a tool for logging meals, weight, fasting and workouts, with friends, challenges and leaderboards. The app provides guideline values based on public food databases and manufacturer information:
- USDA FoodData Central (U.S. Department of Agriculture), public domain
- Open Food Facts; the data is available under the Open Database License (ODbL)
- Bundeslebensmittelschlüssel (BLS, German Nutrient Database), Max Rubner-Institut
- Swiss Food Composition Database, Federal Food Safety and Veterinary Office (FSVO)
- Ciqual, Anses (Table de composition nutritionnelle des aliments Ciqual), under Etalab's Licence Ouverte / Open Licence
- CoFID (McCance and Widdowson's Composition of Foods Integrated Dataset); contains public sector information licensed under the Open Government Licence v3.0
The rights to this data belong to the respective publishers.
Toerdle does not replace medical, nutritional-therapy or psychological advice. If you have pre-existing conditions, are pregnant or breastfeeding, have an eating disorder or take medication, please consult a professional.
Toerdle is not a medical device and not a digital health application (DiGA).
You do workouts, challenges and duels at your own risk. Listen to your body and stop if something doesn't feel right.
If you have an eating disorder or suspect one:
- Germany — Eating disorders helpline (BIÖG, formerly BZgA) 0221 892031 (Mon–Thu 10 am–10 pm, Fri–Sun 10 am–6 pm; landline rate Cologne) and online counselling — essstoerungen.bioeg.de. ANAD e.V. helpline 089 219973-0 (Mon–Thu 8:30 am–4 pm, Fri 8:30 am–3 pm) and online chat *ANAD Dialog* — anad.de.
- Austria — sowhat. Kompetenzzentrum für Menschen mit Essstörungen +43 1 4065717-0 (Mon–Thu 8:30 am–3:30 pm, Fri 8:30 am–12 pm) — sowhat.at.
- Switzerland — PEP – Prävention Essstörungen Praxisnah (Bern) — pepinfo.ch.
If there is an acute risk of suicide:
- Germany — Telefonseelsorge 0800 111 0 111 or 0800 111 0 222 or 116 123 (around the clock, free of charge, anonymous) — telefonseelsorge.de.
- Austria — Telefonseelsorge 142 (around the clock, free of charge from Austria) — telefonseelsorge.at.
- Switzerland — Die Dargebotene Hand 143 (anonymous, confidential) — 143.ch.
If life is in acute danger: emergency number 112. You are not alone — help is within reach.
4. Minimum age
Toerdle is for people aged 16 and over. Before you sign in, you enter your date of birth. If you are younger than 16, you cannot use Toerdle. Please enter your date of birth correctly. If we learn that someone under 16 is using Toerdle, we may block and delete the account.
5. Your account
You need an account for Toerdle. You sign in with your Apple Account ("Sign in with Apple") or your Google account. There is no separate Toerdle password. Keep access to your Apple Account or Google account safe; what happens under your account is attributed to you.
Deleting your account: You can delete your account at any time in the app: Settings → Account and data → "Delete account". What we delete and what remains is described in the Privacy Policy (section 22). Deletion cannot be undone. A running subscription does not end with it; cancel it in your Apple Account (section 9).
6. Sharing health data and social features
Only with your consent: Friends, feed, challenges, live duels and leaderboards only work if Toerdle stores your health and fitness values on our server and shows them to others. For this, the app asks for your explicit consent in a separate step, apart from these terms. Consent is voluntary.
If you don't consent: You keep using Toerdle as a diary, planner and workout app. Friends, challenges and leaderboards stay locked until you turn them on later.
Withdrawal: You can withdraw your consent at any time: Settings → Account and data → Privacy → "Share health data". Sharing then ends, and friends, challenges and leaderboards are locked again. We cannot recall what others have already seen or saved.
Your profile is public: If you have consented, every signed-in Toerdle user sees your display name and your profile photo. There is no private mode. Who sees what is described in the Privacy Policy (section 7).
How you become friends with someone:
- Anyone who uses your friend code, QR code or invitation link, or joins a challenge you created with its code, becomes your friend immediately, without you confirming it. So only give codes and links to people who should see your values.
- Any signed-in Toerdle user can send you a friend request from a leaderboard. You only become friends when you accept.
- If you start a live duel against a random opponent, that person sees your profile and, during the duel, your reps.
You can remove or block a friend at any time. Blocking ends the friendship; you then no longer see each other anywhere (leaderboards, challenges, live duels, feed, profile photo), and Toerdle no longer accepts requests and invitation codes from the blocked person. The block is stored on our server and applies on all your devices. You can lift it in Settings.
7. Rules of conduct
Content and behaviour are not allowed if they
- are unlawful or call for crimes
- insult, threaten, harass or demean others
- discriminate against people for their origin, religion, gender, sexual orientation, disability, age or appearance
- are sexually explicit or glorify violence
- glorify or instruct self-harm or disordered eating
- infringe the rights of others, such as copyright, trademark or personality rights
- spread other people's personal data, such as addresses or phone numbers
- impersonate another person
- are advertising or spam
You also must not
- manipulate leaderboard values, challenge results or duels, for example with made-up values or several accounts
- try out friend codes or invitation links or use codes nobody gave you
- read Toerdle automatically or in bulk, bypass security mechanisms or disrupt operations
- misuse the reporting feature
8. Your content, reporting and our measures
Your content: What you put into Toerdle, such as your display name, profile photo, workout photos, challenge titles and nudges, stays yours. You are responsible for it. You allow us to store this content and show it to the people who see it under the Privacy Policy, for as long as it is stored in Toerdle.
Reporting: "Report" in the app (on people, challenges, live duels, the feed and photos) sends us the report with a reason and a note. Anyone, even without a Toerdle account, can report content they consider unlawful or in breach of these terms by email to support@toerdle.app. Please tell us as precisely as you can which content and which person it is about and why the content is unlawful or breaks the rules. Toerdle checks display names and challenge titles against a list of unacceptable terms when they are saved; names and titles that break the list are rejected.
How we handle reports: We confirm receipt and review every report promptly, carefully and objectively. A human decides, not an automated system. We then tell you our decision.
Our measures: If content breaks the law or these terms, we may remove or block it and suspend the account through which the breach happens, temporarily or permanently. We take into account the severity of the breach and the legitimate interests of everyone involved. If we take a measure, we tell the affected person by email what we did, why, which rule or law we rely on and how they can challenge it. If you disagree with our decision, write to support@toerdle.app; we will then review it again.
Danger to life or safety: If we learn of information giving rise to a suspicion of a criminal offence that threatens the life or safety of people, we inform the competent authorities.
9. Toerdle Pro
Offer: You can use the diary, calorie plan and workouts without Pro. Toerdle Pro unlocks additional features. The Pro page in the app shows you which ones before you buy. Pro is available as an automatically renewing subscription, yearly or weekly. If you bought Pro as a monthly subscription or for life, the terms of that purchase apply to you.
Price: The price shown to you in the app and in the App Store before you buy applies. It may differ by country and currency.
Purchase through Apple: You buy Pro through the App Store. Apple handles the purchase and bills your Apple Account; we receive no payment data. The Apple Media Services Terms apply to the purchase: apple.com/legal/internet-services/itunes.
Renewal and cancellation: A subscription renews for the chosen period unless you cancel it at least 24 hours before the end of the current period. You cancel it in your Apple Account settings.
Free trial: If a subscription comes with a free trial, you see its length and the price afterwards before you buy. If you don't cancel at least 24 hours before it ends, it turns into the paid subscription.
Withdrawal and refunds: Whether you can withdraw from a purchase and get money back depends on the Apple Media Services Terms and the law of your country. You request refunds from Apple; we do not receive payments ourselves and cannot issue refunds.
Restoring: Pro applies to the Apple Account you bought it with. On another device with that Apple Account, you restore your purchase on the Pro page.
Pro gift: Once you fill in your profile, you can redeem a Pro gift once per account: 14 days of Pro, no subscription. It ends by itself; there is nothing to cancel.
Game points: XP, levels and Sweat Drops are game points. They have no monetary value and cannot be bought, sold, transferred or paid out.
10. Availability
We aim to provide Toerdle reliably but cannot guarantee uninterrupted availability. In particular, the features that need a server (account, friends, feed, leaderboards, challenges, live duels) may be temporarily unavailable due to maintenance, faults or outages at service providers. Diary and plan also work without a connection.
Test versions via TestFlight are beta software: they may contain bugs, and features may change or be removed.
11. Data
How we process data is described in the Privacy Policy.
12. Liability
We are liable without limitation for intent and gross negligence, and for damage from injury to life, body or health. For simple negligence we are liable only for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract. Liability under the German Product Liability Act remains unaffected.
We do not guarantee that the nutritional values shown in the app exactly match the actual product. Manufacturers change recipes, and production batches vary.
13. Term and termination
The contract for using Toerdle runs for an indefinite period. You can end it at any time by deleting your account (section 5). You cancel a Pro subscription separately with Apple (section 9).
We can terminate the contract without notice for good cause, in particular for serious or repeated breaches of these terms or if you are younger than 16. Section 8 then applies accordingly.
14. Changes to these terms
We announce material changes to these terms in the app at least six weeks before they take effect and ask for your explicit consent before they apply to you. Editorial corrections, clarifications and legally or technically required adjustments (e.g. new legal duties, Apple requirements) apply without your explicit consent; we show them to you in the app.
15. Governing law and dispute resolution
German law applies. For contracts with consumers, mandatory consumer protection law of the country where you habitually reside remains unaffected.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
16. Contact
Send questions about these terms, reports and complaints to support@toerdle.app. We answer in German or English.
